Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Sparsha Media (OPC) Private Limited ("Sparsha", "we", "us") governing your access to and use of the Sparsha mobile application, this website, and related services (the "Services"). By creating an account or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

• You must be at least 18 years old to create an account or use the Services.
• You must provide accurate information during registration, including your gender, which is verified via a one-time voice check (see our Privacy Policy).
• You may hold only one active account. Creating multiple accounts to evade a suspension, manipulate rankings, or abuse promotional features (referrals, daily tasks, coupons) is prohibited.
• You are responsible for keeping your login credentials secure and for all activity under your account.

Profile verification, including the voice-based gender check, is compulsory before your account can send or receive calls, gifts, or coins. We may request additional verification (such as a profile photo review) at any time to maintain platform integrity, and may suspend accounts that fail or refuse verification.

Full behavioural standards are set out in our Community Guidelines, which are incorporated into these Terms by reference. In particular, you agree not to:

• Share phone numbers, personal social-media handles, or other contact details in chat, calls, or public rooms, or attempt to move conversations off-platform to bypass paid messaging or calling.
• Impersonate any person, or create a fake, bot, or automated account.
• Post or transmit sexual, violent, hateful, or otherwise prohibited content as defined in the Community Guidelines.
• Manipulate coin earnings, referrals, tournaments, leaderboards, or daily-task rewards through fraud, collusion, or automation.
• Circumvent, reverse-engineer, or interfere with the Services' security, payment, or moderation systems.

Coins are a limited, revocable license to access features within the Services — they are not currency, property, or a store of value, have no cash value except through the official creator-payout process described below, and cannot be transferred between accounts, sold, or redeemed for cash by users who purchased them.

• Coins may be purchased with real money, or earned through daily tasks, referrals, watching ads, coupons, and similar in-app activities.
• Coin purchases made through the App Store or Google Play are subject to the payment terms of those platforms, in addition to these Terms.
• Coin purchases and gifts sent using coins are final and non-refundable, except where required by applicable law or platform policy.
• We may adjust coin pricing, earning rates, or promotional offers at any time; changes apply prospectively and do not affect coins already held.
• We reserve the right to suspend or reclaim coins obtained through fraud, exploitation of a bug, or violation of these Terms.

Some features, including Sparsha VIP membership, may be offered as a recurring subscription. Where a subscription auto-renews, it will automatically renew for the same term unless you cancel at least 24 hours before the end of the current period. You can manage or cancel a subscription at any time through your App Store or Google Play account settings — cancelling stops future renewals but does not refund the current billing period, except as required by Apple's or Google's own refund policies.

Prices are shown in the currency and amount set for your storefront/region and may include applicable taxes.

Eligible users (currently, verified female accounts) can earn coins through calls, live streaming, rooms, gifts, and reel monetization, at rates that may vary by rank/level as displayed in the app. Earned coins can be converted to wallet balance and withdrawn to a bank account or UPI ID, subject to:

• Completing any identity/payout verification required by our payment partner.
• Meeting the minimum withdrawal threshold and any daily/weekly limits shown in the app.
• Applicable processing fees and taxes, which are your responsibility to report as required by law.
• Our right to withhold or reverse a payout if we reasonably believe the underlying earnings resulted from fraud, abuse, or a Terms violation.

You retain ownership of content you post (reels, photos, messages), but grant Sparsha a worldwide, non-exclusive, royalty-free licence to host, display, distribute, and promote it in connection with operating and marketing the Services, as described in full in our Community Guidelines. The Sparsha app, website, brand, and all associated software and design are owned by Sparsha and protected by intellectual property law; you may not copy, modify, or redistribute them without permission.

The Services rely on third-party infrastructure for authentication, real-time calls/streaming, payments, and advertising. Your use of features backed by these providers is also subject to their own applicable terms, to the extent disclosed to you in the app.

We may suspend or terminate your account, with or without notice, if you violate these Terms or the Community Guidelines, or if we reasonably believe doing so is necessary to protect the Services or other users. You may delete your account at any time from Settings → Account → Delete Account. Provisions relating to virtual currency, payments, intellectual property, disclaimers, liability, and dispute resolution survive termination.

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that matches, content, or other users' claims about themselves are accurate, and we do not guarantee uninterrupted or error-free operation of the Services.

To the maximum extent permitted by law, Sparsha and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, in the six months preceding the claim.

You agree to indemnify and hold Sparsha harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in India, without prejudice to any mandatory consumer-protection rights you may have under the law of your place of residence.

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by other reasonable means before the changes take effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
